How to Solemnized Marriage Registration in India

Once a marriage is solemnized, the next required thing is registering the marriage. A marriage can be registered in two acts namely Hindu Marriage Act, 1955 and Special Marriage Act, 1954. The Hindu marriage act is applicable to the couple which belongs to Hindus, Jains, Sikhs and Buddhists, even if they have converted their religion. It is not necessary for both parties to follow the same religion, but they must belong to any of the mentioned names. In cases where either of the party belongs to different religion, the marriage will be registered under Special Marriage Act, 1954. Special Marriage act allows you to register your marriage in irrespective religion or caste.

The marriage will be solemnized in the office of sub-divisional Magistrate according to the area you reside in. The registration will take place under office hours only.

The list of documents required for marriage registration:

    • An application signed by both parties
    • The age or date of birth proof of both parties. Matriculation Certificate, Passport, Birth Certificate, any of these will work.
    • To register under special marriage act both parties should be 21 at the time of marriage whereas for registering under Hindu marriage act the required age is 21 and 18 for husband and wife respectively.
    • Ration card of the party whose area SDM is contacted for registration.
    • While registering under the Special marriage act, 30 days stay-proof for any of the party is required.
    • An affidavit which the place of marriage, date of marriage, marital status, date of birth, nationality should be mentioned.
    • Two passport size photo of both parties along with a picture of marriage is required.
    • A fee of Rs-100 and RS 150 for registration under the Hindu Marriage Act, and Special marriage act respectively.
    • If any of the party is divorcee or window/widow, the divorce decree or death certificate of the spouse will be needed.
    • A marriage invitation card
    • If the marriage took place at the religious place the affirmation letter of a priest or respective authority is required.
    • An affirmation letter that none of the party belongs to the prohibited degree of relationship.
    • If any of the party has converted their religion, the conversion certificate will be required

The Criteria to Register the Marriage Under:

Hindu Marriage Act:

To register the marriage under the Hindu Marriage Act, the document verification will take place on the same date of application whereas a specific day is decided and informed to the parties to complete the registration. On the decided date, both parties should be present before the SDM and the certificate will be issued on the same date.

Special Marriage Act:

The presence of both parties for registering your marriage is required after submitting the documents for verification. The two copied notice for marriage are prepared, one is posted on the notice board of registrar’s office and the second copy is sent to both parties individually on the provided address. It takes 30 days to complete the registration once the notice is published. During the 30 days of the period, any objection could be raised. If the objects are invalid or no objects have been made, both parties along with two witnesses must be present at the office of SDM on the date of registration.

How Much Time It will Take to Get a Response?

In normal cases, it will take 15 and 60 days to get a response for registering under Hindu Marriage Act and Special Marriage Act respectively.

Fees for Marriage Registration?

    • Rs.100 for registering under Hindu Marriage Act.
    • Rs.150 for registering under the Special Marriage Act.
